Acceptance & Eligibility
These Terms of Service (“Terms”) govern your use of gatsbyglasscharleston.com, consultation and estimate requests, communications with Gatsby Glass Charleston, and other online services we provide.
By using the website or submitting a request, you agree to these Terms. You must be at least 18 years old and legally able to enter into an agreement. If you do not agree, do not use the website or submit information through it.
Website Information
Website content is provided for general informational and marketing purposes. Photos, renderings, descriptions, estimated timelines, and examples illustrate possible projects and may not represent the exact appearance, availability, specifications, pricing, code requirements, or results for your property.
We may change, remove, or update website content at any time. Website information is not a binding offer, construction specification, warranty, engineering opinion, or substitute for an on-site evaluation and signed project agreement.
Consultations, Estimates & Project Agreements
A website form, call, text, email, consultation, or preliminary estimate does not by itself create an obligation for either party to proceed with a project.
Actual services are governed by a separate written proposal, work order, contract, or other project agreement accepted by the parties. That agreement may include measurements, scope, materials, hardware, price, payment schedule, anticipated timing, warranty, exclusions, and other project-specific terms. If a project agreement conflicts with these online Terms, the project agreement controls for that project.
Customer Responsibilities & Site Conditions
You agree to provide accurate project and contact information and to cooperate with reasonable requests needed to evaluate or complete the work. Depending on the project, this may include:
- Providing safe and timely access to the property and work area.
- Clearing furniture, personal property, pets, and other obstructions from the installation area.
- Disclosing known structural, moisture, electrical, plumbing, hazardous-material, code, access, or property-condition concerns.
- Obtaining owner, landlord, association, architectural-review, or other approvals unless the written project agreement states that we will handle them.
- Ensuring that another contractor’s work is complete and suitable for glass measurement or installation.
Concealed or unexpected conditions may require a change in scope, price, materials, or schedule.
Scheduling, Delays & Changes
Dates and completion times are estimates unless a written agreement expressly states otherwise. Scheduling may be affected by field measurements, custom fabrication, material availability, supplier delays, permits, inspections, weather, site readiness, change requests, or events outside our reasonable control.
Changes requested after approval may require a written change order and additional charges. Custom glass is fabricated to project-specific dimensions; remeasurement, redesign, or changes after fabrication begins may affect cost and timing.
Pricing, Payments & Cancellations
Prices, deposits, progress payments, final payments, taxes, fees, and accepted payment methods are stated in the applicable proposal or project agreement. Unless otherwise stated in writing, website prices or examples are not binding.
Cancellation, rescheduling, refund, and restocking terms are governed by the applicable project agreement. Because glass and hardware may be custom ordered or fabricated, deposits or charges may become non-refundable after ordering or fabrication has begun, to the extent stated in the project agreement and permitted by law.
Materials, Appearance & Warranties
Glass, metal finishes, hardware, sealants, stone, tile, and other materials can vary in tone, reflectivity, texture, edge appearance, tolerances, and natural characteristics. Lighting and surrounding finishes can also affect how glass appears.
Any workmanship, product, or manufacturer warranty is limited to the warranty expressly stated in the signed project agreement or manufacturer documentation. Unless expressly stated in writing, we do not provide additional warranties. Damage caused by misuse, impact, improper cleaning, building movement, third-party work, water intrusion, or unauthorized modification may not be covered.
SMS, Calls & Email Communications
By providing contact information and requesting communication, you authorize us to contact you about your inquiry, consultation, estimate, appointment, project, service, or account. Where you separately consent to marketing, we may also send promotional messages.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to opt out of text messages and HELP for help.
- Consent to marketing messages is not a condition of purchase.
- Wireless carriers are not responsible for delayed or undelivered messages.
- You are responsible for providing a valid number that you are authorized to use.

Acceptable Website Use
You may use the website only for lawful purposes. You may not:

To the fullest extent permitted by law, Gatsby Glass Charleston and its owners, affiliates, licensors, service providers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or online services.
To the fullest extent permitted by law, our total liability arising from the website or online services will not exceed the amount you paid us for the specific online service giving rise to the claim, or $100 if no amount was paid. Liability for an actual glass project is governed by the applicable written project agreement and law.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Gatsby Glass Charleston and its affiliates, personnel, and service providers from third-party claims arising from your unlawful misuse of the website, your violation of these Terms, or information or content you submit without the required rights or authorization.
Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Subject to any controlling project agreement or applicable law, legal proceedings relating to these Terms will be brought in a court of competent jurisdiction in Charleston County, South Carolina.
Changes, Severability & Entire Terms
We may update these Terms from time to time. The “Last updated” date at the top identifies the current version. Continued use of the website after an update constitutes acceptance of the revised Terms.
If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any applicable project agreement, constitute the relevant agreement regarding the subjects they address.
